Let me kindly inform you that the provided draft letter of Agreement does not cover the required provisions necessary to formalize contractual relations between our parties. Therefore, I would like to share with you our draft procurement agreement for your revision. Please kindly send your comments/suggestions ASAP.

 

As for the import license, please note that according to the sub-paragraph „a“ of the Article 1113 of Georgian Law on “Medicines and Pharmaceutical Activities”, pharmaceutical product may be imported circumventing the regimes for granting marketing authorisation in Georgia for non-commercial purposes in case of pre-clinical and clinical trials. The medicine “Remdesivire” will be used within the “Solidarity Trial” and consequently, import license is not required.

 

Hereby, please be informed that in the attached draft Agreement is mentioned that the procured medication will be used only for non-commercial purposes by the medical facilities involved in the trial. However, if you still require the confirmation letter, the AIDS Center will proceed.

Please, be kindly informed that the Ministry is going to procurer initially 4000 vials of Remdesivir 100 mg through Infectious Diseases, AIDS and Clinical Immunology Research Center, which is a state-owned hospital. Therefore, the PO will be sent on behalf of the AIDS Center.

In addition, kindly request you to confirm that by indicating increased amount of Remdesivir in the PO, it will not impose an obligation to purchase full quantity. As I understand, this procedure is necessary only for submission to the export license and in case of additional order we will avoid to go through this procedure again.

For applying Export license, we need a dummy Purchase Order on your letter head may be with some extra quantity like 100,000 vials. We will use this purchase order only for applying export license not for commercial supplies.

 

Mylan has license from Gilead to supply to Georgia. The final price offer would be USD 26.00/vial (CIP Tbilisi)

 

We agree with the payment terms.
