I would like to kindly address you on behalf of the Ministry of Labour, Health and Social Affairs of Georgia regarding the Note on the project “Support to Mental Health Reform in Georgia by Developing New Infrastructure for Mental Health Facilities”.

Pursuant to the legislation of Georgia, the Paragraph 3 of the draft agreement contains provisions determining tax privileges. For the purposes of application of the tax privileges different from those as determined by the Tax Code of Georgia, the agreement is subject to ratification in accordance with the requirement of Part 7 of Article 2 of the Tax Code of Georgia. Accordingly, after the ratification of the Agreement by the Parliament of Georgia the present Agreement shall enter into force on the date of the notification of the Government of Georgia confirming the completion of its necessary internal procedures.

Based on the mentioned, the Georgian side considers necessary to indicate in the draft Note Agreement that the “Agreement shall become effective on the date of receipt by the Government of People’s Republic of China of the written notification from the Government of Georgia of the completing of necessary internal procedures for the entry into force of such Note”.

Hereby, it is essential as well to indicate the project title as it was written in the project application.
